Terms of Service

1. Who we are

MakeSplat ("the Service") is operated by 3Dish ("we", "us"), based in Portugal. The Service converts videos you upload into 3D Gaussian Splat files (.ply) via an API and a web interface. By creating an account or using the API you agree to these terms.

2. Your account

• You must provide accurate information and keep your credentials (including API keys) secure.
• You are responsible for all activity under your account and API keys.
• One account per person or organization; creating multiple accounts to farm free credits is prohibited.
• You must be at least 16 years old to use the Service.

3. Credits and payment

• Processing is paid in credits. Credit costs are displayed before each scan and depend on the quality parameters you select.
• Credits are purchased in packs via Stripe, never expire, and are non-transferable.
• If a scan fails for reasons on our side, its credits are refunded automatically.
• Purchased credit packs are otherwise non-refundable, except where required by law. EU consumers: by purchasing credits and using them you consent to immediate performance and acknowledge the right of withdrawal is lost for consumed credits; unused credit packs may be refunded within 14 days of purchase on request to support@makesplat.com.
• Prices may change; already-purchased credits keep their value (1 credit = 1 standard scan equivalent).

4. Your content

• You own what you upload and what we generate from it. Output .ply files are yours, for any purpose, commercial or not.
• You grant us a limited license to store and process your videos solely to provide the Service.
• Uploaded videos are deleted automatically within 7 days. Generated splats are retained so you can re-download them, until you ask us to delete them.
• You must have the rights to any video you upload. Do not upload content that is illegal, infringes others' rights (including privacy and image rights of identifiable people), or depicts minors inappropriately.

5. Acceptable use

• No attempts to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service.
• No circumventing rate limits, credit accounting, or security controls.
• We may throttle, suspend, or terminate accounts that violate these terms, with refund of unused purchased credits except in cases of fraud or abuse.

6. Service quality and availability

• 3D reconstruction quality depends heavily on your input video. We do not guarantee a particular visual quality; we guarantee the pipeline runs and refund failures.
• The Service is provided "as is" without warranties. We target high availability but do not guarantee uninterrupted operation. GPU capacity is provided by third-party infrastructure and queues can occur.
• We may modify or discontinue features with reasonable notice; if we discontinue the Service entirely, unused purchased credits will be refunded.

7. Liability

To the maximum extent permitted by law, our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be limited under applicable law (including Portuguese and EU consumer law).

8. Changes and contact

We may update these terms; material changes will be announced by email or on the dashboard at least 14 days in advance. Continued use after changes take effect constitutes acceptance.
